As Steve said 'As professionals we should not be fitting un-approved mods even with a signed disclaimer. If it became manufacturer approved then no problem (Not likley to happen).' Couldn't have put it better. Kevin in relation to 'Can we agree on one fact these teves unit have a design fault.' Yes they have a fault, be it at design or component level we dont know and there in lies another problem with us fitting modified parts. We are not qualified to say if it is a design or component fault nor are we qualified in the eyes of the law to say if any modification is an improvement or not. We do not have access to the kind of test facilities required to make that kind of decision. Have the new Teves unit been upgraded?? We dont know. Has the Badly Botched Aftermarket unit been tested to the same level as the Teves units (ie how many hundred thousand of them are over three years old) NO, so how do we know its an improvement? Some maybe BUT most of the liability will be with the qualified tech who fitted a modified non approved critical brake part. I'm sure you can think of more than a few examples of dodgy modifications done to cars whereby the parts fitted themselves are legal to sell but dangerous(and illegal in some cases) when fitted. Basically when push comes to shove WE as trained, experianced techs are in the final decision position as to what we should and should not fit therefore WE ARE LIABILE for our work. If someone wants to take a gamble with their own future to save a customer a few hundred quid then thats up to each of you. But I know from my experiance that the type of customers who would put you in this position to start with would not do it for you if the roles were reversed. Until it is approved by the manufacturer then in the eyes of the law it is an unapproved modification. I see your point here but as with most things nowadays common sense does not prevail.
