To be honest cant remember having this particular problem, not that we fit that many DMF's Unless pinion was very / visibly badly worn i would expect increased noise to be more of a issue than crank speed (with old pinion on new ring gear)
do recall a problem once where starter dowels where missed when refitting and that caused a slow crank issue. I suppose always risk of poor earth & damaged wires / crank sensor, clearly these would be addressed FOC before handing car over to customer
sorry to hear this has got as far as court, are you willing to elaborate on the situation, must be more than cost of a starter motor.
