A customer of mine has a show-condition BMW 840 which was damaged when he hit a badger late one night.After a lot of hassle from his insurance co because he wanted to use his own repairer, they told him they were classing it as a cat D write off and valuing it at £6000.After his £500 excess he could buy the car back for £1800 which would then leave him £3700 to do what he wanted with the car.
I know this car has had thousands spent and still looks stunning from most angles.I and other specialists value this car at £9-10,000 so i believe the ins co have incorrectly written this car off.
He is of course furious with the ins co and refuses their offer, saying that he will drop the claim and pay for the repair himself as he is adamant he does,nt want the car listed as a cat D write off which will affect the cars future value.
The ins co now say that the car will have a cat D marker against it whether he pursues the claim or not!

My question is can the ins co mark this car as a cat D, against the owners will, even though they havent paid out a claim?

The damage will eventually be repaired regardless .
