Hi Sean My experiences have been quite different to yours. The following link was all about, of all things, an old CF Bedford Ice Cream Van. Common sense would steer a tester toward a decision that would protect little children. Neither common sense or an "NTs oppinion" should be associated with VOSA. The fact that you have documented your "observation" that the brake linings are worn, badly worn or appear to be close to the metal etc etc, is enough to releive the NT of any liability. If the customer is advised, then it is their call! We recently attended a appeal against us on a Daewoo Matiz, that the customer claimed had a dangerously worn track rod end. As the Vosa guys tested it I said to John (my tester in question) "that looks fu**ed John" & he agreed. It had been six weeks since our test & it had not been advised. I thought we were screwed. The VOSA guy beckoned us over & drew our attention to the joint & said "well lads, this has significant play in it, but to be honest I wouldn't blame you if you failed it or pass & advised it today & in this conditions!" I couldn't believe it, it was fuc**d! Like I said, with the publicly available test information available on line, the main pressure on the tester, is to document as much as possible & cover their ass! Cheers Dave
