Info for anyone who finds themselves in this situation be very careful what action you take.
We have a car now for approximately 18 months and after taking legal advice we were advised that this type of situation comes under the TORTS(Interference With Goods) Act 1977. Fact sheet available at www.tameside.gov.uk/tradingstandards/factsheets/31.
As we understand it after speaking to our insurance company's free legal helpline. WE ARE UNDER OBLIGATION TO TAKE CARE OF THE VEHICLE AS SOON AS IT IS IN OUR CARE AND CONTROL. We were also advised that if we disposed of the vehicle any monies we received must be put in a bank account for i think is was for six years. If the owner took us to court the court would not look favorably at any monies we had taken. This is still ongoing and will post info when a settlement is reached. We are adding storage at £8.00 per day which we think is approximately half the standard insurance charge.

    HTH Tommy
