Well because the fence is there does not mean its the end of the property, down around Chicago the track dept usually marked the rail with paint where ownership ended. Sometimes it didn't even go back to what is called the fouling point. It could even be in a contract on who is responsible. We had a location where the lumber yard would push the car outside the gate. The other catch with this is was the rail covered in snow so you could not see the issue. I never saw what actually caused the derailment, it just said loggers. That could be anything, broken rail, debris on the track, knocked out of line.
