A possibility is that the freight going to CN is being handled under what are known as haulage rights. LSRC being the entity that deals with the customer to provide service between the origin and destination. But haulage rights would be operated by each railroads crew. I don't think that is what is going on at Flint.
A CN crew in the cab would be an issue over LSRC tracks from what I know. That CN unions don't seem concerned means whatever going on must be okay.
Haulage rights are outside of STB jurisdiction.
