During the last half of 2009, I spent my time trying to keep our restaurant going, and fighting a foreclosure action that Wells Fargo had brought against us that occurred because of what I was told by them that was a “computer glitch.” Over the course of this action, Wells Fargo made three critical “mistakes,” any one of which should have given us a victory. Unfortunately, the judge ignored them. We appealed, and the Court of Appeals dismissed our appeal on a technicality that the court always uses when it does not want to consider an appeal. The truth of the matter was … because of the recession, the state of Kentucky was broke. The judicial branch had limited funds to operate from and it laid off a good number of its administrative personnel so it could survive. Unlike many other states, Kentucky got rid of the foreclosure actions as quickly as possible so that they would not clog up the system.
This was a very trying period for us.
