Bashir had lied to a graphic artist who mocked up the bank statements, thus involving him the deception. The man who was supposedly taking bribes to betray Diana was falsely accused and libeled. Bashir did lie to Diana and play on her vulnerabilities, which he did to further his own career without a thought to the people he injured or deceived. I don't think his actions fall within the statutes of liability for a criminal case, and I'm not sure that his actions were actually crimes. But I do think he should be punished. Diana should have done her own due diligence and taken her concerns about being spied on to the authorities, or at least sought the queen's advice. That was her failure.
