I don't know what an "issue of fact" is, but it appears from what I was able to google, that it is a disputed fact and is determined by a jury. I cannot read the article because I won't pay to read, but is this basically what the judge has decided--a jury is needed to determine if Harry's feelings were hurt or if he was traumatized?
