Each case is considered on it's own merits. In this case Police Scotland Police Scotland decided they would not be taking any action, saying the first minister had apologised and "acknowledged this inadvertent breach" of the regulations.

The First Minister removed her face mask briefly to talk to people at a funeral wake. It was a minor breach of the rules. Just because she is First Minister doesn't mean that we should all come down on her like a ton of bricks. She has held up her hands and admitted she has made a mistake.
