I have a Kindergarten student w/ apraxia who I feel should qualify and would benefit immensely from extended school year. He has made tremendous growth this year, but is still only 35% intelligible to a familiar person w/in a familiar context. This would be detrimental to him going into a regular classroom next year. According to our LEA, the only way he could qualify is if I provide data that he is unable to recoup 60% of what he had gained for up to 6 weeks after Christmas and show regression?? I can't support these requirements w/ the data I have. This would restrict ESY services to only students who are mainly Life Skills/severe autism, which is illegal. What do other districts do? I work in PA so any of you with knowledge of spec ed laws might be of particular help here. I plan on advocating all the way to the best of my ability for this student.
