Now this HAS to be an intentional play on words with this headline, considering all the 'charges' against Johnson-Klein that were brought up during the trial (stealing pain medicine from players, poor decision-making, etc):
Johnson-Klein offers to lower her judgment
The Fresno Bee
04/01/08
Stacy Johnson-Klein is offering to settle her gender-discrimination case against Fresno State for about $200,000 less than what she and her legal team are owed, her lead attorney said Tuesday.
Johnson-Klein lawyer Warren Paboojian said in a two-page letter to Fresno State lawyer Susan Westover that the total judgment against Fresno State now exceeds $9.4 million.
This includes a $6.6 million judgment for Johnson-Klein and $2.5 million in attorneys' fees. Paboojian said interest is accruing at nearly $54,000 a month.
Johnson-Klein will accept $9.2 million, Paboojian told Westover.
"My client is willing to reduce her judgment by over $200,000 in an effort to resolve this matter as expeditiously as possible," Paboojian said.
The Bee received a copy of Paboojian's letter shortly after 5 p.m. Tuesday. Westover is an attorney with the California State University system. The Bee left a phone message for Westover, but was unable to contact her.
Fresno State fired Johnson-Klein in March 2005, alleging she violated university policies. She sued the university in August 2005, alleging she was fired for her advocacy of gender equity.
A jury unanimously sided with Johnson-Klein in December, awarding her $19.1 million. Fresno County Superior Court Judge Donald S. Black later reduced the judgment to $6.6 million, which Johnson-Klein has accepted.
Fresno State is appealing the verdict, and Johnson-Klein has filed a cross-appeal. The two sides have expressed interest in holding settlement talks.
