    RT Racing Moto Virus Win Bol Appeal Against Michelin Honda

    RT Racing appealed against the decision to give Michelin Power Honda a 40 lap penalty after they were found to have an oversized fuel tank at the Bol d'Or last month. The penalty meant that Michelin Power still scored championship points at the Bol despite being caught cheating.

    The appeal was successful, and Michelin Power have been disqualified from the results of the Bol d'Or.

    This leaves RT Racing in second place in the championship standings, 1 point ahead of SERT and the Sapeurs Pompiers.

    Appeal of Team RT Racing Moto Virus

    The International Disciplinary Court (CDI) convened in a single judge phone hearing (Mr. Jacques Bourguignon) on October 9, in order to judge the appeal lodged by Team RT Racing Moto Virus against the decision taken by the FIM International Jury during the “Bol d’Or” held in Magny Cours on September 12&13.

    Circumstances: At the end of the Bol d'Or on September 13, 2009, during the technical control after the race, it was found that the machine of the Michelin Power Research Team had a fuel tank with a capacity of 24.860 liters which is an infringement of Art. 2.6.6.11 § 3 of the FIM Road Racing Endurance World Championship and Cup Regulations which allow the use of a fuel tank with a maximum capacity of 24 liters.

    In consequence of this infringement, the International Jury inflicted a penalty of 40 laps by decision notified to the Michelin Team on September 13, 2009 at 7.30 pm.

    Reason for appeal: The reason for this appeal is based on changes of championship points awarded to the competitors following this sanction and its consequences on the overall classification.

    Decision: The Commission considered the appeal admissible, quashed the decision of the Jury taken on September 13, 2009 and took a sanction of disqualification according to Art. 2 §3 of the Endurance Technical Regulations. The costs of the procedure are to be borne by the FIM.

    An appeal may be lodged against this decision before the International Tribunal of Appeal (TIA) pursuant to Arts. 4.5, 4.6 and 4.7.1 of the FIM Disciplinary and Arbitration Code.
