Was this student's first language evaluated for speech and language difficulties? Many times during the acquisition of the second language, (even though he speaks English)an ESL learner will follow the normal acquisition sequence of the second language. It is very normal for this student's syntax and grammar structure to be behind his native English speaking peers. It would be a good idea to find out about how ESL is he? Meaning, how often the native language is spoken at home, if he has had evaluations in the native language, and his language profiency level in both languages. Someone at the school, like a bilingual coordinator, usually tests these students to get an understanding of how proficient ESL students are in the second language. Anyway, I would not worry about the grammar due to the fact that he possibly still is in the acquisition stage of the second language. I would work on activities that give this student choices on correct syntax/grammar production this way the student can hear and interpret the correct as well as incorrect structures.
