Yes. I believe there may be personal legal ramifications by servicing more than your state's designated maximum caseload. A maximum is designated by a state so as to ensure quality service for the student's who are under a current IEP. What you can do is wait up to one semester to start servicing students after they qualify. Hopefully, you may have a child to dismiss or a child may move out before the end of the semester to open up a spot. If a spot does not open, the district should send a letter home offering to pay for an outside therapist's service until they can provide services by a new hire. The district only has to prove that they are actively looking for additional SLP's and then they are off the hook legally - you however, are not off the hook legally if you start servicing just one child over your maximum. Check with your state division of ASHA to confirm your state's special education law.
