The problem is that local counties, municipalities and other authorities continue to promulgate their own special hunting and fishing regulations outside the proper channels of the Fish & Game Commission. Example: Pacific Grove, a town near Monterey, declared a marine reserve on its own. The courts decided that the authority resides with the F&G Commission and the DFG. Still, they keep trying. -Jim Martin Here's the scoop from CWA: ACTION ALERT AB 2146 (Canciamilla) – Prohibition on Local Governments Impacting Hunting and Fishing Activities April 13, 2006 Please help us pass AB 2146 (Canciamilla), a CWA-sponsored bill that would prevent cities and counties from adopting local ordinances that restrict or ban hunting and fishing activities. In recent years, a number of cities and counties have inappropriately attempted to insert themselves into the regulation of fish and game, often at the behest of animal rights groups or anti-hunting individuals. Notable examples include the cities of Morro Bay, Hercules and Mountain View, each of which has attempted to ban waterfowl hunting on publicly-owned lands or waters. AB 2146 would help rein in these local governments by prohibiting them from adopting ordinances which impact the taking of fish and game unless it is for legitimate public safety reasons. The bill would also prevent the State Lands Commission from giving away the public hunting and fishing rights on navigable waters of the state, as has occurred on portions of Tomales and San Diego Bays, without the Fish and Game Commission’s public review and approval. Anti-hunting groups are currently gearing up to fight against AB 2146, as they want to retain every venue possible to restrict hunting and fishing activities. This bill reaffirms a California Supreme Court decision, In re Makings (1927) 200 Cal. 474, which determined that the State of California has legal jurisdiction over the taking of fish and game. The Court found that a constitutional amendment approved by California voters in 1902 (currently Section 20 of Article IV) prohibits cities and counties from regulating, or interfering with, fish and game matters and places that responsibility with the Legislature. Subsequent to the decision, the Legislature delegated to the Commission regulatory powers over the taking of fish and game. The decision, along with other legal changes, led to a reduction in poaching and further benefited fish and wildlife by helping to ensure that their populations are managed from a statewide, rather than parochial, perspective. It also contributed greatly to the professional, science-based administration of fish and game laws that California largely enjoys today. However, a few local governments still occasionally attempt to directly regulate hunting, fishing and other wildlife management activities, mostly because there is no definitive statutory language that restricts them from doing so. Unfortunately, the relevant court decisions on this issue are obscure and not widely available to local governments, while there is no legal requirement to ensure appropriate communication between cities and counties and the Commission. Because local regulations relating to fish and game are not reflected in the Commission’s regulations, most sportsmen traveling throughout the state are also fully unaware of them. AB 2146 would therefore provide much needed statutory clarity and guidance for local governments by reaffirming the Supreme Court’s decision. The bill would encourage greater communication and coordination with the Commission and Department of Fish and Game, both of which have the necessary expertise in game regulations and science-based wildlife management. AB 2146 would further help to better conserve California’s fish and wildlife resources by ensuring that all game regulations are appropriately reviewed and approved by the Commission. Because the Commission’s regulations are widely read and available to sportsmen and women, AB 2146 would also facilitate greater compliance with our Fish and Game laws. AB 2146 would ensure the Commission appropriately reviews and approves all our hunting and fishing regulations.
