Great points. Yet I would argue that menthol's popularity with African-Americans increases the chances it will stay on the market and not get banned. There are two ways of looking at it. One way, such as this article, claims it is "racist" to keep menthol on the market since menthol cigs kill a disproportionate amount of AA smokers.
Another way to look at it is that it's racist to take away a product that so many Africn-Americans enjoy. It would look like they are picking on blacks, especially if non-menthol cigarettes stay on the market. This in my opinion will be the viewpoint that wins out even if antis don't like it. Yes, African-Americans probably make up a minority of all menthol smokers. Yet at the same time the vast majority of African Americans who do smoke... smoke menthol.
