We also never put our name on any submitted proposals, staying entirely invisible in the proposal. It is each CONTRACT between the nonprofit and the fund developer consultant that get filed with the regulating body, in addition to annual registration, not copies of the actual proposals. I guess I might not understand your question. The NONPROFIT is also required to register in any state where they solicit funds that requires it, so if you are questioning how you get 'caught', I know how that happens in PA. The PA Bureau of Charitable Organizations made a presentation at a meeting I attended, and said that they have a select group of PA citizens who are asked to save all of the fund solicitations they receive all year, and bring them to an annual luncheon hosted by the Bureau. The Bureau reviews all of these solicitations to make sure the requester is duly registered with the Commonwealth. Likewise the regulating body has foundation partners (I think Pew & Mellon were mentioned, not positive anymore) that also report all proposals that do not contain the required disclaimer verifying registration. But it's not you as the unregistered consultant apt to get in trouble here (at least not initially), it's the unregistered nonprofit, (who then will very likely throw you under the bus for getting them in trouble.) It was a scary presentation. I do wonder how the Bureau has the resources to police this, but they do seem to have a pretty big staff & I know they have a team of lawyers on staff. I try hard to toe the line. Does that answer the question? If not, ask me again.
