Arlene: I immediately thought of Tony Poderis and advice he has offered in the past. It was nice to see you linked a very good conversation regarding this topic which had occurred before. I do not know that I could effectively add to what was so reasonably stated by both yourself (above) and Tony (in archived message thread). It appears on the surface that statements you made are logical and respectful of the chain of command in an organization. People should never be 'guaranteed' a position...it is a place of public trust between constituents, mission, values and trustees which must be reviewed on a regular basis. One of the most critical things in nonprofits is oft overlooked...Perhaps the most advantageous and timely exercise a board can engage is an annual performance review for the Executive Director. This is something which one would expect in the for profit sector and should never be overlooked in the non profit sector. This helps to reinforce the relationship between the board of directors (leaders of the organization) and the ED (employee of the organization). Not only that, but helps all to be comfortable with how well the ED is carrying out the mission and related job duties for which he/she is entrusted while providing a platform for correction if something is amiss. A firing should in that case never come as a surprise, but rather flow from lack of responsiveness to review issues or another reasonable lack of employment responsibilities. When officers of the organization (Board) carryout their duties relative to the Executive Director through performance reviews, it alleviates lack of understanding in these issues, and protects all concerned from litigious situations.
