about these points...
What relationship do you hold for/on either the school board or the private foundation?
Did the foundation have a mission statement, structural formation meetings, etc. necessary for legal formation of the foundation? Assuming they did, just how does funding the school play in that mission? Is it just one school, an entire district, county? Is it a private school, or public? (you mention public funding).
As I said, I am a little confused from your comments, and know that sometimes the short space doesn't tell the whole story. Whether or not the structure is legal, at first glance, their does seem to be at least an ethical/conflict of interest going on.
