The rights has not been recinded to my knowledge, and stem from this decision:
If it's been used, it's very very very rare - maybe once a decade... and I really have my doubts since qualification for the territory would mean multiple runs with a CN pilot.. so I don't think it has really ever been a thing.
But.. it does exist. Maybe it's just a measure to keep CN honest about service - as CSX could in theory just run their own trains if it ever needed to be done.
My understanding is these rights were granted in light of the potential merger of BNSF/CN but I don't remember exactly the context after all this time.
