Yes, there would be regularoty control issues if Berkshire-Hathaway ever purchased another railroad. This is now different than regulations regarding ownerhship of multiple railroads back in the Rail Baron days.
The purchase of BNI (BNSF's parent company) still does face regulatory approval anyway.
The question might be how will this affect other Bershire-Hathaway owned companies. I'm sure he owns plenty that use rail as a transport mechanism for goods and services.
Will this potentially lead to more traffic for BNSF from those companies.
