Yes, they'd need STB permission to merge but I believe that both RRs could be owned by the same entity without merging. IE: Berkshire could be a majority owner of both with out approval. It's similar to a situation like RailAmerica, they can own all of the individual shortlines but merging them into one takes STB approval. Not a perfect example but I believe it applies.
