: The Shanes entered into a lease deal with Josh and Mike, apparently in 2016 if the
: plaintiffs are to be believed, but failed to tell Rick, Bill, George and Nikki Gary.
: So Fuji Productions continued to book gigs for "The Kingston Trio"
: featuring the current configuration that extended well past the cut-off point of
: August 1, 2017.
: Josh and Mike saw that as a breach of contract, and rightly so. They should have
: taken this up with Bob and Bobbie. Instead, they had their attorney file a suit for
: trademark infringement and dilution against Bill, Rick, George and Nikki/Fuji, also
: seeking an injunction that bars the defendants from using said trademark for the
: next decade. Probably not the best way to handle this, but that's what lawyers do,
: especially Hollywood lawyers.
: Why the Shanes weren't named in the suit is unclear, though one can speculate. Why
: they didn't tell the band is a whole different subject, and to me unconscionable as
: well as unfathomable.
: This was handled very poorly by all parties involved, with the exception of Bill,
: Rick and George, who are victims of collateral damage.
: In fact, if they wanted to file a suit of their own, they've got a pretty strong
: case. But they'd have to file it against the Shanes, and I can't see that happening.
